Official Contest Rules SPITZ GIVEAWAY Rogers Broadcasting Limited Contest Rules 1. (a) Contest Period (“Contest Period”) starts at 12:01am on April 27, 2012 and ends at 7:07pm on October 3, 2012 (the "Contest Closing Date"). To enter visit http://www.sportsnet590.ca/contests/ and complete the on-line entry form in full and submit it by the Contest Closing Date. All times are Eastern. One (1) entry per person. Rogers Blue Jays Baseball Partnership (the “Club”) is in no capacity a legally-liable sponsor, prize supplier or in any way connected to the Contest. (b) NO PURCHASE NECESSARY. To enter this Contest without completing the on-line entry form during the Contest Period, please hand print your name, address, day and evening phone numbers, email address, age, Contest name for which you are entering for a chance to win, and a 100 word handwritten letter explaining why you want to win an autographed Brett Lawrie jersey, and mail it to SPORTSNET 590 The FAN, One Ted Rogers Way, Toronto, Ontario, M4Y 3B7, Attention: SPITZ GIVEAWAY. You will receive one (1) entry into the Contest during the entry period for which your request was postmarked and received, to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request during the Contest Period. (c) A random draw, by Rogers Broadcasting Limited ("Rogers") representative, will be made each time a Toronto player hits a two-base hit as defined by the rules of Major League Baseball during a 2012 Toronto Blue Jays regular season game (the "Draw Dates"), at Rogers' office at One Ted Rogers Way, Toronto, Ontario M4Y 3B7 from all completed entry forms received by 11:59pm the day before each Draw Date. Each selected entrant will be deemed a Qualifier and receive one entry in the Weekly Draw as outlined below. (d) If Brett Lawrie hits a two-base hit as defined by the rules of Major League Baseball during a 2012 Toronto Blue Jays regular season game, the Qualifier selected as outlined in section 1.c will receive one additional entry in the Weekly Draw as outlined below. (e) If no Toronto player hits a two-base hit during a 2012 regular season game, no Qualifier will be selected. Non-selected entries will be carried forward to the next Draw Date. (f) Random Weekly Draws will be made by a Rogers representative on April 30, May 7, 14, 22, 28, June 4, 11, 18, 25, July 3, 9, 16, 23, 30, August 7, 13, 20, 27, September 4, 10, 17, 24, October 1, and 9, 2012 from the previous week’s pre-determined Qualifiers. Each selected entrant will be eligible to win one (1) of twenty-four (24) prizes of an autographed Brett Lawrie jersey. The approximate retail value of each prize is $110.00. Non-selected qualifiers will not be carried forward to the next draw date. If there are no pre-determined qualifiers, no Weekly Draw will be made and no prize will be awarded. 2. (a) If a selected entrant cannot be reached within 14 days or declines the prize, the prize will be forfeit. (b) In the event that a selected entrant incorrectly answers the skill testing question, the prize will be forfeit. (c) Only one (1) entry per person. If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s). 3. No purchase, expenditure or investment is necessary to enter this Contest. 4. All prizes must be accepted as awarded. Rogers reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize. 5. In order to win, selected entrants must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time. Rogers judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes. 6. Entrants will be required to return a signed release and acknowledgment form before being declared a winner. 7. By entering this Contest, each Contestant consents to the use of his/her entry, name, city of residence and/or photograph in any publicity carried out by Rogers and/or its advertising agencies, without further compensation. Winners consent to their photograph being taken by Rogers for such use, without further compensation. All entries become the property of Rogers. 8. This Contest is open to residents of Canada, excluding residents of Quebec, who have reached the age of majority in their province of residence as of the date of entry, except employees of Rogers, PepsiCo Canada ULC, Major League Baseball, their parent and affiliate companies (collectively, the “Sponsors”); their representatives and agents, the Contest suppliers and those with whom they are domiciled. The Contest is subject to all applicable provincial and municipal laws and regulations. 9. No correspondence will be entered into except with the selected entrants. 10. Chances of winning depend on the number of eligible entries received. Rogers is unaware of how many entrants there may be. The winner(s) may come from any geographic area, so long as they otherwise qualify to enter the Contest. 11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers. Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors. All entries become property of the Sponsors who assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Sponsors reserve the right, in their sole discretion, to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 12. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant provides Rogers with explicit permission to do so as indicated on the entry form. This Contest will be run in accordance with these rules, subject to amendment by Rogers. Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest. 14. End User agrees not to place on this site any content that violates, plagiarizes or infringes upon the rights of others, including copyright, trademark, the right of privacy or the right of publicity, or that would be abusive, profane, obscene, indecent, threatening, defaming, slanderous, libelous, offensive, or otherwise illegal. End user agrees not to solicit the performance of any activity that is prohibited by law. End User agrees to comply with all applicable laws, rules and regulations in connection with this End User Agreement. End User agrees not use the Service in connection with surveys, junk email, spamming, or any duplicative or unsolicited messages (commercial or otherwise). End user agrees not to restrict or inhibit any other user from using and enjoying the Service. If End User uses this site from outside the United States of America, he/she is entirely responsible for compliance with applicable local laws, including, without limitation, the export and import regulations of other countries in relation to the Service. Privacy As part of the registration process, End User will provide certain personal information to UPICKEM and its licensees. Except as provided herein, UPICKEM and its licensees agree to use the End User individualized information only for internal purposes; UPICKEM and its licensees may, however, provide the End User information, in an aggregate form with the information of other End Users, to third parties, but only in such a way that the End User’s individual privacy is protected. UPICKEM and its licensees may contact End User periodically to provide him/her with news, other information, or offers which it believes would be of interest to him/her. Opt-out mechanisms are available if End User prefers not to provide his/her information to third parties. All uses of End User information will be in accordance with the provisions of UPICKEM's Privacy Policy, which can be accessed by clicking on the link titled "Privacy Policy" at the bottom of this web page. Content and Monitoring UPICKEM is a distributor (and not a publisher) of content supplied by third parties and users of the Service. Accordingly, UPICKEM has no editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers and users, are those of the respective author(s) or distributor(s) and not of UPICKEM. End User understands and acknowledges that UPICKEM neither endorses nor is responsible for the accuracy, completeness or reliability of any opinion, advice, information, or statement made in use of the Service by anyone other than authorized UPICKEM employee spokespersons while acting in their official capacities. Copying, redistribution, or publication of copyrighted material, or changes to or deletion of author attribution or copyright notice are prohibited. Downloaded software may not be reverse engineered unless specifically authorized by owner of the software. End User may download public domain content for its own use. End User assumes all risks regarding the determination of whether any content is in public domain. Third Party Interaction This site may be linked to other sites on the World Wide Web or Internet which are not under the control of or maintained by UPICKEM. Such links do not constitute an endorsement by UPICKEM of those sites. End User agrees that UPICKEM is providing these links to End User only as a convenience, and further agree that UPICKEM is not responsible for the content of such sites. In End User’s use of this site, he/she may enter into correspondence with, purchase goods and/or services from, or participate in promotions of advertisers, sponsors and other users of this site. Any such correspondence, purchase or participation, including the delivery of and the payment for goods and/or services, and any other term, condition, warranty or representation associated with such correspondence, purchase or participation is solely between End User and the applicable third party. End User agrees that UPICKEM has no liability, obligation or responsibility for any such correspondence, purchase or participation between End User and any third party. Trademarks Certain of the names, logos, and other materials displayed in the Service constitute trademarks or intellectual property of UPICKEM or other entities. End User is not authorized to use any such marks. Ownership of all such trademarks and other intellectual property remains with UPICKEM or those other entities. No permission is granted to hyperlink other Internet sites with any page in this site. End User agrees not to "frame" or "mirror" any of the contents or pages contained on or accessible from this site on any other server or Internet-based device without the advance written authorization of UPICKEM or its licensors, as applicable. This authorization terminates automatically, without notice to the End User, if he/she breaches any of the Terms of Service. Disclaimer of Warranty; Limitation of Liability END USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT END USER’S SOLE RISK. NEITHER UPICKEM NOR ANY OF THEIR INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES PUBLISHER, UPICKEM NOR ANY OF THEIR INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. End User hereby acknowledges that the provisions of this section shall apply to all use of and content on the Service. End User acknowledges that the content on the Service, by its nature, may involve a level of risk, including, without limitation, personal injury, property damage or other dangers. In no event shall UPICKEM's total liability to End User for all damages, losses and causes of action whether in contract, tort (including its own negligence) or under any other legal theory (including strict liability) exceed the amount paid by End User, if any, for accessing the Service. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, inaccuracy, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of the Service and content therein, under any legal theory or cause of action. Indemnification End User agrees to indemnify, defend and hold harmless UPICKEM, its affiliates, licensors, officers, directors, employees, consultants, licensees and agents from and against any and all claims, demands, liability, damages and/or costs (including, but not limited to, investigation and attorneys' fees) arising from End User’s use or any user of End User’s account of the Service or content therein, their violation of the Terms of Service, or their infringement, or infringement by any other user of their account, of any intellectual property or other right of any person or entity. Miscellaneous The Terms of Service will be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to its conflict of laws provisions or End User’s actual state or country of residence. End User agrees to submit to the jurisdiction of the courts located in Washtenaw County, in the State of Michigan, for the resolution of all disputes arising from or related to these Terms of Service and/or his/her use of the Service. The Terms of Service will inure to the benefit of UPICKEM's successors, assigns and licensees. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by UPICKEM. If any provision of these Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of UPICKEM to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision unless acknowledged and agreed to by UPICKEM in writing. These Terms of Service constitute the entire agreement between End User and UPICKEM with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding this subject matter. UPICKEM can revise these Terms of Service at any time without notice by updating this posting, and End User agrees that their continued use of the Service after such revisions have been posted constitutes their acceptance of such revised Terms of Service. Neither party may assign or transfer this Agreement to any other person or entity without the prior written consent of the other party, (which consent shall not be unreasonably withheld), provided however that UPICKEM may assign the Agreement to another entity: (i) owning a majority of its outstanding stock; (ii) into which it merges, (iii) which acquires all or substantially all of its assets. The provisions of this Terms of Service are for the benefit of UPICKEM and their contractors, information providers, service providers, licensors, employees, licensees and agents; and each shall have the right to assert and enforce such provisions directly on its own behalf. Any acknowledgment of an e-mail or other communication from End User that is in any way inconsistent with, or adds to, the provisions of these Terms of Service is null and void. Neither the course of conduct between parties nor trade practice shall act to modify the provisions of these Terms of Service. UPICKEM may authorize or allow its contractors and other third parties to provide to UPICKEM and/or to End User services necessary or related to making the Service available and to perform obligations and exercise rights of UPICKEM under these Terms of Service. Any obligations or duties which by their nature extend beyond the termination of these Terms of Service shall survive any expiration or termination of these Terms of Service. UPICKEM and/or third parties may from time to time send e-mail messages to End User containing advertisements, promotions and other such information. UPICKEM makes no representation or warranty with respect to the content of such email messages or any goods or services which may be obtained from such third parties, and End User agrees that neither UPICKEM nor such third party shall have any liability with respect thereto. Recognizing the above, End User chooses to voluntarily enter this space and to use the Service and to not hold Licensee or UPICKEM responsible for any action or inaction on either of their parts. End User chooses to use the service and to abide by the terms of service set forth here.
